Draft. These terms are waiting for FirstScapes to confirm them and are not yet in force.
Terms and Conditions
How our quotes, bookings, payments and guarantee work, in plain English.
About These Terms
These terms apply when you ask FirstScapes Ltd (“FirstScapes”, “we”) to carry out landscaping work at your home. We are registered in England and Wales, company number 17174662.
They sit alongside your written quote. If the quote and these terms ever disagree, the quote wins.
Nothing in these terms takes away your legal rights as a consumer.
Your Quote
Every quote is free and follows a visit, so it is based on your garden rather than a guess. You get it in writing and itemised, so you can see what you are paying for.
A quote stays valid for [client: proposed: 30 days] from the date on it. After that, material prices may have changed, so we may need to update it.
The price covers the work and materials listed, and nothing else.
Some things cannot be seen until we dig, such as buried rubble, old foundations, unmarked pipes or poor ground. If we find something like this, we will stop, show you, and agree any change to the price with you in writing before we carry on.
Booking the Work
Our agreement starts when you accept the quote in writing. An email is fine.
We then agree a start date with you. To hold the date and order materials, we ask for a deposit of [client: proposed: 25% of the quoted price].
Your Right to Cancel
If you agree to the work at your home or at a distance (by phone or email), the law gives you 14 days to change your mind. The 14 days start on the day after you accept the quote.
To cancel, tell us by email at jack@firstscapes.co.uk or by phone on 01494 812249. You do not need to give a reason.
If you cancel in time, we refund any deposit within 14 days of hearing from you.
If you want us to start within the 14 days, you need to ask us to in writing. If you then cancel, you pay for the work we have done up to that point, in proportion to the full price.
Paying Us
After the deposit, you pay [client: proposed: the balance within 7 days of the work being finished. On jobs longer than two weeks, we may agree stage payments with you at the start, set out in the quote].
We take payment by [client: proposed: bank transfer]. We will never ask you to pay into a different account than the one on your invoice. If anyone does, please call us first.
[client: proposed: Materials delivered to your home remain ours until the work is paid for].
While We Are on Site
Jack, who founded FirstScapes, is on site every day the job runs.
We will keep to the agreed start date where we can. Weather, ground conditions or material deliveries can cause delays. If that happens, we will tell you as soon as we know and agree a new date.
If you would like to change the design once work has started, we will tell you what it means for the price and the timing, and agree it with you in writing before we do it.
[client: proposed: We clear our waste from site and leave the work area tidy at the end of each day].
What We Need from You
- Access to the garden and the work area on the agreed days.
- [client: proposed: Use of an outside tap and a power socket].
- [client: proposed: Somewhere safe to put materials and, if needed, a skip].
- Anything you know about underground pipes, cables or drains, before we start digging.
- Any planning permission, listed building consent or neighbour agreement the work needs. We will tell you if we think it needs one, but getting it is your responsibility.
Materials
Natural stone varies in colour and texture from slab to slab, and timber moves and weathers over time. That is part of what they are, not a fault.
[client: proposed: If a material we quoted becomes unavailable, we will offer you an equal or better alternative and agree it with you before we use it].
Our Guarantee
Our work is guaranteed for 10 years, covering craftsmanship and materials. Where the work is timber, such as decking, fencing and pergolas, the guarantee is 5 years. It starts on the day we hand the finished job over to you.
If something we built fails because of our workmanship or the materials we supplied, tell us and we will come and put it right at no cost to you.
The guarantee does not cover [client: proposed: normal wear and tear; damage from misuse, accidents or work by others; plants and turf, which are living and depend on care; timber that has not been maintained as we advise; or materials you supplied yourself].
The guarantee is in addition to your legal rights, not instead of them. The law says our work must be carried out with reasonable care and skill.
If Something Goes Wrong
Please tell Jack straight away by phone or at jack@firstscapes.co.uk. We will come and look, and put right anything that is our responsibility.
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or not using reasonable care and skill. We are not responsible for losses that were not foreseeable, or for business losses.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, or for fraud.
Your Details
How we handle your personal details is set out in our privacy policy.
The Law That Applies
These terms are governed by the law of England and Wales.
